4. Our lawful bases for using personal information

UK data protection law requires us to have a lawful basis for processing personal information.

Depending on the circumstances, we rely on the following bases.

Contract

We process information where it is necessary to provide Noise Club to you or to take steps at your request before entering into a contract.

This includes administering your account and subscription, processing your campaigns, storing your content and carrying out requested publishing activity.

Legitimate interests

We may process information where it is necessary for our legitimate interests or those of another person, provided those interests are not overridden by your rights and interests.

Our legitimate interests may include:

  • operating and improving Noise Club;
  • securing our systems and accounts;
  • preventing fraud and abuse;
  • diagnosing faults;
  • providing customer support;
  • maintaining appropriate business records; and
  • understanding and improving the performance of our service.

Legal obligation

We process information where necessary to comply with legal obligations, including applicable tax, accounting, regulatory and law-enforcement requirements.

Consent

Where required, we rely on your consent.

This may include the use of certain analytics or other non-essential cookies and technologies.

Where processing is based on consent, you can withdraw that consent at any time. Withdrawing consent does not affect processing that was lawful before it was withdrawn.

5. Automated production

Noise Club uses automated and semi-automated software processes to produce content from the material and campaign settings you provide.

For example, the service may select from permitted source material, prepare video layouts, place text, apply selected visual treatments and create platform-ready files.

These processes are used to provide the service you request.

Noise Club does not use automated processing to make decisions about you that produce legal effects or similarly significant effects.

6. Who we share information with

We use third-party providers to operate Noise Club.

Depending on how you use the service, personal information may be processed by providers involved in:

  • website and application hosting;
  • cloud storage and file processing;
  • payment processing;
  • email delivery;
  • authentication and security;
  • social-media connection and publishing;
  • website analytics; and
  • technical infrastructure and support.

These may include services provided by organisations such as SiteGround, Google and Stripe, as well as publishing infrastructure used to connect Noise Club to supported social platforms.

Where you connect or publish to a third-party platform, relevant information may also be supplied to that platform. Supported platforms may include Facebook, Instagram, TikTok, YouTube, Threads and Bluesky.

Those platforms process information under their own privacy policies when acting independently of Noise Club.

We may also disclose information:

  • where required by law or a valid legal process;
  • to protect the rights, security or property of Noise Club, our users or others;
  • in connection with a corporate restructuring, acquisition or sale of the business; or
  • where you have asked or authorised us to do so.

We do not sell your personal information.

7. Payment processing

Subscription payments are processed by third-party payment providers, including Stripe.

Payment providers may collect information directly from you, including payment-card and billing information, and process it under their own privacy terms.

Noise Club receives the information necessary to administer your subscription and understand the status of payments without needing to store your complete card details.

8. Social platforms

Noise Club allows you to connect supported third-party social accounts so that content can be scheduled or published.

When you choose to connect an account, information may pass between Noise Club, our publishing infrastructure and the relevant social platform as necessary to establish the connection and carry out your instructions.

The availability and operation of those connections also depend on the relevant platform’s systems, APIs, policies and privacy practices.

You can disconnect supported social accounts using the facilities provided by Noise Club or the relevant platform.

9. Storage and Google services

Noise Club may use Google services to store and process files associated with accounts, artists and campaigns.

This can include music, footage, production files and related campaign material.

We use access to these services only as necessary to provide, maintain and secure Noise Club and carry out the actions requested through the service.

10. How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including providing the service and meeting legal, accounting, security and dispute-resolution requirements.

Different types of information may therefore be retained for different periods.

While your account is active, we generally retain information necessary to operate it.

If your subscription or account ends, some information and uploaded material may be deleted after a reasonable retention period. You should not use Noise Club as the only archive of important original music, footage or other creative material.

We may retain certain records for longer where reasonably necessary for:

  • accounting and tax requirements;
  • fraud prevention;
  • security;
  • enforcing agreements;
  • resolving disputes; or
  • complying with law.

Backup copies may remain for a limited period after information has been removed from active systems.

11. International transfers

Some of the service providers and platforms used by Noise Club may process personal information outside the United Kingdom.

Where UK data protection rules relating to international transfers apply, we take steps to ensure that an appropriate legal mechanism is in place. Depending on the destination and provider, this may include UK adequacy regulations or appropriate contractual and other safeguards.

You can contact us if you would like further information about the safeguards relevant to your personal information.

12. Cookies and similar technologies

Noise Club uses cookies and similar technologies where necessary to operate the website and service.

We may also use optional technologies for purposes such as analytics where you have provided any consent required by law.

You can find more information about the technologies we use, their purposes and your choices in our Cookie Policy.

13. Security

We take reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

No internet-based service can guarantee absolute security.

You are responsible for keeping your Noise Club login credentials secure and should contact us promptly if you believe your account has been accessed without permission.

14. Your data protection rights

Depending on the circumstances and the lawful basis on which we process your information, UK data protection law may give you rights including:

  • the right to be informed about how your information is used;
  • the right to access personal information we hold about you;
  • the right to have inaccurate information corrected;
  • the right to request deletion of information in certain circumstances;
  • the right to request restriction of processing in certain circumstances;
  • the right to object to certain processing;
  • the right to data portability in certain circumstances; and

We may need to verify your identity before fulfilling a request.

15. Your right to object

You have the right to object to processing based on our legitimate interests in certain circumstances.

You also have an absolute right to object to your personal information being used for direct marketing.

To object, contact info@noiseclub.co.uk.

16. Marketing

If we send electronic marketing where consent is required, we will obtain the necessary consent.

You can opt out of marketing communications at any time using the unsubscribe method provided in the communication or by contacting us.

Service messages relating to your account, subscription, campaigns, security or operation of Noise Club are not marketing messages and may still be sent where necessary.

17. Children

Noise Club subscriptions are intended for people aged 18 or over.

We do not knowingly offer paid Noise Club accounts to children.

If you believe a child has provided us with personal information in circumstances where they should not have done so, please contact us.
